Fulmenta Terms & Conditions

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must stop using Fulmenta immediately.

2. Description of Services

Fulmenta provides tools and services that allow users to:

• Create and customize digital product designs (including AI-generated content)
• Upload and store artwork and design files
• Place orders for production and fulfillment
• Connect external stores or marketplaces to sell products
• Access paid subscription-based platform features

Fulmenta is not a marketplace and does not guarantee product sales or business results.

3. Account Registration

To use Fulmenta, you must:

• Be at least 16 years old
• Provide accurate account information
• Maintain the security of your login credentials
• Not use another person's identity or business information without authorization

Fulmenta reserves the right to suspend or terminate accounts that violate these Terms.

4. User Content & Intellectual Property

Any content uploaded or generated by the user, including images, artwork, text, brand assets, AI prompts, and product designs, remains the sole responsibility of the user.

By using Fulmenta, you confirm that you own or have legal permission to use all uploaded content.

Fulmenta is not liable for copyright, trademark, or intellectual property violations committed by users.

5. Subscriptions & Billing

• Fulmenta offers recurring subscription plans billed automatically via Stripe.
• By subscribing, you authorize recurring monthly charges to your saved payment method.
• Subscriptions continue until cancelled by the user.
• Subscription payments are non-refundable.
• Plan changes or price adjustments may be made with prior notice to users.

6. Orders, Production & Fulfillment

When a user places an order, it is automatically forwarded to our production partners for manufacturing.

Orders cannot be cancelled or refunded once production has started.

Fulmenta is not responsible for:

• Incorrect shipping addresses provided by the user
• Delivery delays caused by carriers (UPS, DHL, FedEx, etc.)
• Refund requests from the user's own customers

7. Refund & Return Policy

Because all products are custom-made, no refunds or returns are accepted unless the item is defective.

Defect or quality claims must be submitted within 7 days of delivery to [email protected].

8. Prohibited Use

Users may not use Fulmenta to upload, create, or sell:

• Copyrighted or trademarked material without permission
• Violent, hateful, illegal, or abusive content
• Sexual content involving minors
• Fraudulent, deceptive, or misleading content
• Malware, harmful code, or attempts to disrupt the platform

Fulmenta may disable or permanently delete accounts that violate this policy without refund.

9. Service Availability & Liability Disclaimer

Fulmenta is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free functionality, or compatibility with all devices.

Fulmenta is not liable for:

• Service interruptions or downtime
• Loss of data or content
• Issues caused by third-party services (Stripe, Supabase, shipping carriers, etc.)
• Loss of revenue, sales, or business opportunities

To the fullest extent permitted by law, Fulmenta's maximum liability shall not exceed the total fees paid in the last 30 days.

10. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA. Any dispute shall be handled through binding arbitration or the courts of New Jersey.

11. Changes to These Terms

We may update these Terms at any time. Material changes will be announced via email or dashboard notice. Continued use of Fulmenta after changes means you accept the updated Terms.

12. Etsy Trademark & API Use

The term Etsy is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc. Fulmenta provides fulfillment infrastructure only and does not act as an Etsy partner, affiliate, or representative.

We connect to Etsy via the official OAuth flow with your consent to sync listings and orders for fulfillment. We do not pull payment card data from Etsy. We request only the minimum scopes needed to import listings, read orders, and update shipment statuses.

13. Data Use, Freshness, and Cache

Etsy-derived data (listings, assets, orders, shipping details) is used solely to produce, pack, and ship your orders. Data freshness is enforced: we refresh Etsy data at least every 6 hours and do not display listing data older than 6 hours. Cached Etsy data is retained only as needed for active fulfillment and is cleared when access is revoked.

Fulmenta adheres to Etsy API rate limits and implements request pacing to avoid exceeding Etsy thresholds.

14. OAuth Permissions and Revocation

You may revoke Etsy access at any time from your Etsy account. After revocation, we cease Etsy API calls and purge cached Etsy data kept for fulfillment, except where retention is legally required (e.g., tax or billing records).
